Virginia Velocity (“Virginia Velocity,” “we,” “our,” or “us”), a program sponsored by the Secretary of Commerce and Trade of the Commonwealth of Virginia,  values and respects your privacy. This Privacy Policy (“Privacy Policy”) describes the types of information, including Personal Information, that we, or certain third parties engaged by us, gather from you when you use our website (http://www.virginiavelocity.org/) (the “Site”), as well as your choices regarding use and disclosure of your Personal Information. As used in this Privacy Policy, “Personal Information” means information that identifies you or would enable someone to contact you, such as your name, email address, phone number and other non-public information that is associated with such information.

YOUR AGREEMENT TO THE PRIVACY POLICY

By accessing the Site, you agree to be bound by this Privacy Policy. Each time you access the Site, the current version of this Privacy Policy will apply. Accordingly, whenever you access the Site, you should check the effective date of this Privacy Policy (which appears at the top) and review any changes since the last version. This Privacy Policy is applicable to all visitors to the site, including without limitation applicants to, and judges and mentors of, the Virginia Velocity business plan competition (the “Competition”).

INFORMATION COLLECTED BY VIRGINIA VELOCITY AND THIRD PARTIES

Virginia Velocity and certain third party service providers collect information (i) that you knowingly and voluntarily provide (such as through forms or profile screens) including registration/account setup information and application materials, and (ii) that such third parties are able to collect from your web browser, cookies and other similar technologies.

Information that You Knowingly and Willingly Provide

Virginia Velocity collects information that you provide in the Judge Interest Form and the Mentor Application.  Virginia Velocity uses this information solely to (i) evaluate your interest in serving as a mentor or judge in the Competition and (ii) contact you in connection with such interest and for other purposes reasonably related to such interest and the Competition.

iStart, an online service provided by The Ewing Marion Kauffman Foundation, also collects information that you provide when you apply for the Competition.  This information includes, without limitation, the following kinds of Personal Information:

  • First and last name
  • Home address
  • Email address
  • Phone number
  • LinkedIn profile
  • Company information

iStart may also collect and store Personal Information about other people that you provide. This includes information that you provide to us in your application. If you use iStart to provide Personal Information about others, or upload content that contains such Personal Information, that information will be used as discussed below. You hereby acknowledge that you have the appropriate consent(s) from any individual (or the parent of any child under the age of 13) to share any such Personal Information with us through iStart.

All information, including any Personal Information about you or others, that you provide to iStart will be shared with Virginia Velocity.  Virginia Velocity will use such information solely in connection with the administration of the Competition.

Non-Personal Information

Virginia Velocity uses Google Analytics and MediaMath (the “Third Party Providers”) for advertising and promotional services in connection with the Competition.  The Third Party Providers collect information that is sent automatically by your web browser each time you visit the Site. The Third Party Providers may use this information to generate aggregate statistics about visitors to the Site. This information typically includes details about your:

  • IP address
  • Browser type
  • Browser plug-Ins
  • Operating system
  • Local time zone
  • Visits to particular pages on the Site (including the date and time of such visits)
  • Referring site and/or search engine
  • Device type (e.g. desktop, laptop, tablet, phone, etc.)
  • Screen size, color, depth, and system fonts

The Third Party Providers may obtain information about you by installing “cookies” on your computer’s hard drive. Cookies may be used to collect statistical information about the ways visitors use the Site, including which pages they visit, which links they use, and how long they stay on each page. If you do not wish for cookies to be installed, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer.

The Third Party Providers and other third parties also may collect information about your activity on the Site and on third-party sites and applications using tracking technologies. Tracking data collected by the Third Party Providers can be used to decide which ads you see on third party sites and applications, but does not identify you personally.

HOW VIRGINIA VELOCITY USES YOUR INFORMATION

Our use of information about you is governed by the Government Data Collection and Dissemination Practices Act, Va. Code Ann. § 2.2-3800 et seq., as amended (the “GDCDPA”).

We may use online Personal Information we collect about you on its own or combine it with other information we have about you to:

  • Evaluate applications in connection with the Competition;
  • Perform internal operations, such as tracking and improving the effectiveness of the Site  and our marketing efforts;
  • Provide user support;
  • Provide information to our representatives and/or advisors, such as our attorneys, accountants, and others to help us comply with legal, accounting, or security requirements;
  • Protect the rights, safety, and information of users of the Site and third parties, as well as our own. This includes fraud prevention, business or product recalls, prosecuting and defending a court, arbitration or similar proceeding, and more;
  • Comply with legal requirements, such as in response to a subpoena or similar investigative demand.

Virginia Velocity will require all semi-finalists to satisfactorily complete a background check, which will be conducted by a third party. All information obtained as a result of a background check will be used solely for purposes of administering the Competition and will be kept confidential.  Each semi-finalist will be required to complete an authorization form. Failure to timely complete an authorization may result in termination of Virginia Velocity’s further consideration of your application. Falsification or omission of information may result in immediate dismissal from the Competition.

HOW WE SHARE INFORMATION WE COLLECT

Virginia Velocity may disclose your Personal Information in the following instances:

Agents

We may employ other companies and individuals to perform functions on our behalf. Examples of such functions include sending postal mail and e-mail, analyzing data, providing technical support, providing marketing assistance and providing customer service. We may share our users’ Personal Information with these agents as we deem necessary for such agents to perform their functions.

Volunteers and Consultants

The Competition relies, in part, on the participation of volunteer judges and mentors, and may engage consultants in connection with administration of the Competition (collectively, “Volunteers and Consultants”).  Virginia Velocity will share information about you, including Personal Information, with Volunteers and Consultants as reasonably necessary for such Volunteers and Consultants to fulfill their responsibilities in connection with the Competition.  The Volunteers and Consultants will be required to agree to certain confidentiality obligations with respect to applications and supporting materials, but Virginia Velocity cannot guarantee that the Volunteers and Consultants will abide by such obligations.

Employees

Only authorized employees have access to your personal information.

Affiliates and Subsidiaries

Virginia Velocity may share Personal Information with agencies and instrumentalities of the Commonwealth of Virginia for uses consistent with this Privacy Policy.

To Comply with Legal Process, Protect Virginia Velocity or Enforce our Rights. We may release your Personal Information when it is necessary to (a) conform to legal requirements, including without limitation the VA FOIA (as defined below), or comply with legal process; (b) enforce or apply our agreements; (c) protect the rights, safety or property of Virginia Velocity, our affiliates, service providers, our users or the public; or (d) prevent a crime or protect national security (including exchanging information with other companies and organizations for fraud protection and credit risk reduction).

Because Virginia Velocity is sponsored by the Secretary of Commerce and Trade of the Commonwealth of Virginia, any information about you, including Personal Information, that is held by Virginia Velocity may be subject to public disclosure under the Virginia Freedom of Information Act, Va. Code Ann. § 2.2-3700 et. seq. (the “VA FOIA”), which provides generally that all records relating to a public agency’s business are open to public inspection and copying, unless exempted under the VA FOIA or otherwise prohibited by the GDCDPA.

Other Disclosures

We may also disclose your Personal Information as otherwise set forth in this Privacy Policy, as permitted by law or with your consent.

Selling of Personal Information

We will not sell your Personal Information to third parties.

Children and Privacy

Participation in the Competition is limited to persons who are at least 18 years of age. The Site is not directed to persons under the age of 18. If you are not 18 years or older, please do not enter any Personal Information on the Site, and ensure you have the permission of a parent or guardian before viewing the Site.

Links to Third Party Sites

The Site contains links to third party websites, applications and services, including without limitation social media websites and applications, not operated by us. These links are provided as a service and do not imply any endorsement by Virginia Velocity of the activities or content of these sites, applications or services nor any association with their operators. Virginia Velocity is not responsible for the privacy policies or practices of any third party including websites or services directly linked to the Site. We encourage you to review the privacy policy of any third party site that you visit.

SECURITY, STORAGE, RETENTION AND REMOVAL

Security

We take reasonable technical and organizational precautions to protect the confidentiality, security and integrity of your Personal Information. Although we use security measures to help protect your Personal Information against loss, misuse or unauthorized disclosure, we cannot guarantee the security of information transmitted to us over the Internet. While we strive to use commercially acceptable means to protect your Personal Information, there is no guarantee that information will not be accessed, disclosed, altered or destroyed.

Storage

The Personal Information that you provide to us is generally stored on servers located in the United States. If you are located in another jurisdiction, you explicitly ACKNOWLEDGE AND CONSENT that once your Personal Information is submitted through the Site, it will be transferred to our servers in the United States and that the United States currently does not have uniform data protection laws in place.

Retention

We will retain your information for as long as needed to provide you with our services. If you wish to request that we no longer use your information to provide you service, contact us at info@virginiavelocity.org. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Removal

If you wish to have information about you (including Personal Information) removed from our records, please contact us at info@virginiavelocity.org or via phone at (804) 371-7017. We will respond to such inquiries within fifteen (15) business days.

Changes to this Privacy Policy

We reserve the right to update or modify this Privacy Policy from time to time. We will notify you of any changes by revising the “Effective Date” at the top of this Privacy Policy. If we make any material changes to this Privacy Policy or the way we use, share or collect Personal Information, we will post an announcement of the changes on the Site, prior to the new policy taking effect. In all cases, your continued use of the Site constitutes consideration and your binding acceptance to any such changes. We encourage you to review this Privacy Policy regularly to ensure that you are familiar with Virginia Velocity’s current practices.
